3.Make a contract with us
3.1When you place an order with us, you are making an offer to buy products or to subscribe to regular receipt of products. We will charge your credit or debit card, PayPal account or digital wallet at the time of checkout. We will send you an e-mail to confirm that we have received your order (the Order Confirmation) but it does not indicate that a contract exists between us.
3.2We will indicate acceptance of your order, and hence a contract between us, when we send you an e-mail confirming dispatch (the Dispatch Confirmation). In the unlikely event that the products are no longer available, or that we have made a pricing mistake, we will advise you of this as soon as possible and will provide a full refund taken on the order, upon which point there will be no contract between us.
3.3While every care has been taken to ensure product information is as accurate as possible, all information provided is intended to give a general description of the products and is provided in good faith. Food products especially are constantly being changed and reformulated by manufacturers and we would therefore recommend that you do not rely solely on the information on our website and always check products labels or contact the manufacturer. British Gift Box are unable to accept liability for any incorrect information.
3.4Images of products on this website are for illustrative purposes only. We will always send you the latest products that are available from our suppliers so your products may vary slightly from the image shown on the website due to manufacturer changes, etc., and will not include any accessories that may be pictured, unless stated in the specification of the products.
4.How to place an order
4.1You can use our website to place an order by selecting the product you wish to buy and adding it to your basket. Items you do not require can be removed from your basket at any time.
4.2The buyer assumes responsibility for the products being suitable for the purpose for which they are being purchased and for the accuracy of any personalisation messaging or details to accompany the products purchased.
4.3All prices quoted on our website are in Pounds Sterling (GBP).
4.4All prices are inclusive of VAT, where applicable.
4.5All prices exclude shipping and delivery costs, options and charges for which will be shown for you to choose from and which will be added to the total amount due before you place your order.
4.6You will be required to pay for the products at the time of ordering, and for applicable subscriptions, subsequently at each auto-renewal, as detailed in the FAQ “When will I be billed?”. You hereby authorise the Company to bill you as per these payment terms. We reserve the right to terminate any contract if we are refused payment.
4.7We use secure encrypted payment facilities for online purchases. You can pay for your order by credit and debit cards, PayPal as well as the latest mobile payment and digital wallet services (including Apple Pay and Google Pay). We only accept payment in GBP. If your ‘home’ currency is not GBP, your credit card, PayPal account or digital wallet will automatically convert the GBP payment to your home currency when you pay.
4.8Prices are liable to change at any time, but changes will not affect orders in respect of which we have already sent you a Dispatch Confirmation or for pre-paid subscriptions that have outstanding deliveries yet to be dispatched.
4.9Promotional prices only apply during the period stated.
4.10Only coupon codes obtained from our Website will be honoured. Coupon codes sent with a Gift Card have a 5 year limit and can be used any time within 5 years of issue but any other coupon codes from this website that are over 6 months old can be considered expired and will not be accepted unless specified.
4.11Once your order has been confirmed, changes may not be possible or may incur additional charges or delays.
5.Shipping & delivery
5.1We aim to dispatch your order within 2 working days after your order is processed and payment is received and within 2 working days of the anniversary date for Subscription Boxes, and sooner than that if we can. You will receive an email to let you know when your order has actually been dispatched (the Dispatch Confirmation).
5.2Please see the International Shipping page for further details of our shipping services as well as the shipping section of our FAQs on how it works.
5.3We will deliver the products to the premises you specify on your order. It is your responsibility to ensure that the address details that you provide are correct. This should include a contact name and business name, if being shipped to a business, house name and number and a full postal/zip code. A contact phone number and email address for the recipient is required at checkout should the delivering courier need to contact them regarding delivery. British Gift Box will not be held responsible for any incorrect address details provided by the customer.
5.4It is your responsibility to ensure someone is at home to accept delivery of your order so we encourage you to select a delivery address that will have someone available to sign for your parcel. All orders delivered by courier will need a signature on delivery. If the recipient is not there to receive a parcel the courier will attempt to deliver to an immediate neighbour or alternatively leave a card with contact details so that redelivery or collection can be arranged. If the courier doesn’t receive a response to the card, they will return the parcel to us after 4-5 working days.
5.5British Gift Box is not responsible for lost or stolen packages that you choose to send by an untracked shipping service or for packages that are confirmed to be delivered, including loss or damage if the courier has to leave the products with a neighbour and it is then subsequently left unattended. Upon enquiry, British Gift Box will confirm delivery address the delivery was made to, date of delivery, tracking information and shipping carrier information to the customer to investigate.
5.6If you change the delivery address once the products have been dispatched, we reserve the right to pass on any extra charges made by our carriers for redirecting your delivery, if the carriers are able to make the change. This will delay your delivery.
5.7If your order has not arrived within the designated time please call or email us.
5.8Please check the products on delivery – any products found to be missing or damaged should be notified to us within 48 hours of delivery of the items.
5.9If an order is refused by the recipient we cannot refund the cost of the products or shipping.
5.10Where a component of a box is out of stock we will provide a substitute product of at least equal value to the out of stock item.
6.Risk and title
6.1The products will be at your risk from the time of delivery.
6.2Ownership of the products will only pass to you when we receive full payment of all sums due in respect of the products, including delivery charges.
7.Consumer protection: cancellation and returns
7.1If you are contracting as a consumer, we are pleased to provide a 14 day ‘no quibble’ policy for order cancellation, even with our Gift Box products being sent all over the World. In accordance to Consumer Contracts Regulations, we offer a 14 day cooling off period from the date of delivery. This means that we will refund the total cost of the product to you if you choose to cancel your order for any reason provided you comply with the following terms:
7.1.1You must inform us of your cancellation in writing by email to [email protected] within 14 calendar days of delivery.
7.1.2The products remain unused and component parts are unopened.
7.1.3You or the recipient retain and take reasonable care of the goods and package the goods to be returned securely.
7.1.4You or the recipient are responsible for returning the products to us within the same 14 day period to our address shown in section 2, clearly marking the package with your name and order number so we know who it is from. You will be responsible for the cost of returning the products to us.
7.1.5We receive the products back in an undamaged and fully re-saleable condition and they are within a reasonable range of their “sell-by”, “use-by” or “best before” dates.
7.2Exceptions to our ‘no quibbles’ cancellation policy:
7.2.1Our cancellation policy applies to individual orders of products and to subscriptions for regular deliveries of Gift Box products. It only applies to Gift Card orders to the extent that the email delivery of your eGift Cards will occur prior to the end of the 14 day cancellation period and you accept that your right to cancel this order will cease once the eGift Card has been delivered to the recipient email address provided.
7.2.2You may not cancel or return Gift Boxes containing short shelf life products as we are unable to resell these products. The Gift Boxes containing short shelf life products are clearly identified on the product pages of the website.
7.3Refunds for qualifying cancellations and returns are detailed in clause 9.1
8.Damaged or defective products
8.1If you or your recipient receive damaged or defective products or if we have made a mistake with your order the following terms in section 8 apply:
8.1.1You must notify us of the damage or defect or error within 48 hours of receipt by email to [email protected].
8.1.2When damage occurs during delivery, we require photographic evidence from you to demonstrate that the individual product(s) in the package are indeed damaged. Damage is deemed to involve breakages, ruptures and other material impairments which affect the fitness for consumption, usefulness or functionality of individual component products but does not include minor deterioration to product packaging and containers, such as dents to tinned items. If we are satisfied that the product(s) have been damaged, and that the damage has been caused in transit, we will refund the relevant portion of the order value that has been damaged, as detailed in clause 9.2.
8.1.3If any products are defective, we require photographic evidence from you to demonstrate that the individual product(s) in the package are non-conforming to the manufacturer’s standards. If we are satisfied that the product(s) are indeed defective, we will refund the relevant portion of the order value that is defective, as detailed in clause 9.2. Due to transit times, products with short shelf lives are sold on a non-refundable basis and are not considered defective even if they are slightly past their “Best Before” date when they reach the recipient. The Gift Boxes containing short shelf life products are clearly identified on product pages of the website.
8.1.4If we make a mistake and you receive goods that you did not order or there are missing products in your package then we will refund you the cost of your missing goods.
8.2As an exception to our damaged or defective products policy, for all deliveries sent to countries outside the EU, we cannot provide a refund or provide a replacement product where damage or loss of items in the package has been caused by customs authorities or their agents.
9.Our refunds policy
9.1If you have cancelled the contract between us within the 14-day cooling-off period and have returned the products to us in accordance with the terms in 7.1, we will issue a refund within 14 days of safe receipt of the products for the full price of the products, excluding delivery charges and any customs duties or fees that may have been incurred at initial delivery.
9.2If you or your recipient receive damaged or defective products or we have made a mistake with your order and you have complied with the terms in 8.1, we will refund the relevant portion of the order value that has been affected, up to the full value of the order if 100% of the products have been affected.
9.3All refunds will be made to the card, PayPal account or digital wallet used to pay for the purchase.
9.4British Gift Box is not responsible and cannot refund for lost or stolen packages that you choose to send by an untracked shipping service or for packages that are confirmed to be delivered by the courier. Upon enquiry, we will confirm delivery address the delivery was made to, date of delivery, tracking information and shipping carrier information for the customer to investigate.
9.5If your parcel is returned to us following unsuccessful delivery attempts, or due to you providing incorrect address details, we will have to re-charge you the shipping costs to re-ship your order. If you decide to not have your order re-shipped then we cannot refund the cost of the products purchased.
9.6Products with short shelf lives which are clearly identified as such on our website are sold on a non-refundable basis.
